User (“you”, “your”): This refers to the individual or business purchasing a subscription plan from Cuzo Limited in return for the Service.

Service: This refers to the website development, email services and additional features offered by Cuzo in relation to purchasing one of our subscription plans.

Website: This refers to the website developed by Cuzo for the User, including all associated files and content.

Email: This refers to the email service provided to the User by Cuzo, including all associated files and content.

By using this Site and our Service, you indicate that you have read, understand, and formally agreed to these Terms and Conditions and agree to always abide by them. We reserve the right to modify or update this policy at any time, and it is the User’s responsibility to review the policy periodically.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Site is the property of Cuzo Limited and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, your service will end at that next billing date.

Subscriptions

Your subscription automatically renews, and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, you must raise a ‘Ticket’ with our support team, who will inform you when the cancellation has been processed. Please be aware that cancellations may take up to 5 working days, it is your responsibility to request cancellation with sufficient time to avoid being billed for a consecutive month.

Payments

We accept the following payment methods on our Site:

• Stripe

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Free Domain Provision

As part of the WebPro subscription service, you are entitled to a free domain, subject to the following conditions:

• Domain Eligibility:
  • The free domain must be a .co.uk domain.
  • The domain must be available for purchase at the time of registration to our Service.
  • The domain cannot be a previously registered or designated as a premium or resold domain.
• Activation Conditions:
  • The free domain offer will only be available after the completion of any free trial period associated with the subscription, and;
  • The first subscription payment must be successfully processed and received prior to the activation of the free domain offer.
• Non-Transferable:
  • The free domain offer is non-transferable and is exclusively linked to the active WebPro subscription.
  • If you cancel your subscription and wish to transfer the domain to another provider, the transfer is permitted.
  • We Charge an administrative fee for the transfer process. The fee is £25.00 +VAT.
• Additional Costs:
  • Any optional services or premium domain features associated with the domain are not included and will incur additional charges.

Right to Cancel

If you are a customer living in the United Kingdom or the European Union, you have the right to cancel your contract to purchase services from us within 14 days without giving notice. The cancellation period:

• Will end 14 days from the date of purchase when you purchased a service.

To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at accounts@cuzo.io or submit a ‘Ticket’ to our support with a reason for cancellation.

Ownership and Intellectual Property Rights

By subscribing to our website development services, you acknowledge and agree that the website, including its design, source code, content management system, and associated intellectual property (collectively referred to as “the Website”), remains the sole property of Cuzo Limited

During the term of your subscription, we grant you a limited, non-exclusive, revocable license to use the Website for your business purposes, provided that your subscription remains active and payments are up-to-date.

If your subscription is canceled, terminated, or otherwise discontinued, Cuzo Limited retains full ownership and control of the Website. The Website will not be transferred, released, or provided to you, in whole or in part. This includes access to its source code, hosting environment, or any other proprietary assets associated with the Website.

While Cuzo Limited retains ownership of the Website, you retain ownership of all content you have provided for the development of the Website, including text, images, and other media.

Upon termination, you may request a copy of this content, which will be provided in a standard format, excluding any proprietary or design elements of the Website.

By using our services, you confirm that you have read, understood, and agreed to these terms regarding ownership of the Website.

Consumer Protection Law

Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

Cuzo Limited and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Cuzo Limited and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or   your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Country of England.

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, if you and Cuzo Limited are unable to resolve any dispute through informal discussion, then you and Cuzo Limited agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Cuzo Limited. The costs of any mediation or arbitration will be paid by the unsuccessful party.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
